\nSince u been gone, Kelly Clarkson\u2019s divorce from Brandon Blackstock turned nasty.<\/p>\n
As part of the legal battle being waged between Clarkson and her former management company, Clarkson has accused members of Starstruck Management \u2014 specifically Brandon and his father Narvel \u2014 of fraud and \u201cillegal services.\u201d<\/p>\n
In documents filed in Los Angeles \u2014 first reported by OK! \u2014 and obtained by Page Six, Clarkson, 38, describes her partnership with Starstruck as a \u201cfraudulent and subterfuge device\u201d for Starstruck\u2019s \u201cillegal services\u201d as unlicensed agents.<\/p>\n
Narvel\u2019s original lawsuit claims that Clarkson owes Starstruck $1.4 million and that she would continue to owe them money based on her earnings from \u201cThe Voice\u201d and her eponymous talk show. Clarkson\u2019s filing with the California Labor Commission alleges the Blackstocks were not licensed to act as agents in California, and hid that fact from her while \u201cdemanding unconscionable fees,\u201d \u201cacting in conflict of interest\u201d with her, \u201cgiving false information and\/or making false representations.\u201d<\/p>\n
California\u2019s Talent Agencies Act is a section of its labor code that requires agents operating in the state to be licensed and bonded; Clarkson alleges that Starstruck neither obtained the bond nor her written approval to act as her agent.<\/p>\n
Clarkson and attorney Edwin McPherson put forth that \u201cbased on the wrongful acts and conduct of [Starstruck Management and the Blackstocks] \u2026 all agreements between the parties, should be declared void and unenforceable.\u201d They\u2019re seeking to halt Clarkson\u2019s payments to Starstruck and further, to have her previous payments to the firm refunded to her.<\/p>\n
OK! suggests that a ruling in the case will be made in February, though the mag adds that given the controversial nature of the Talent Agencies Act, the case could wend its way to the Supreme Court, as \u201cmany advocates on both sides [would] like to see a definitive ruling on what some believe to be an unconstitutional regulation.\u201d<\/p>\n
This is all separate from Clarkson and Blackstock\u2019s divorce after seven years of marriage. November alone saw Clarkson be awarded primary physical custody of the couple\u2019s children \u2014 daughter River Rose, 6, and son Remington Alexander, 4 \u2014 and Blackstock request close to $450K a month in spousal support from Clarkson. However, OK! notes that, per the couple\u2019s prenuptial agreement, the latter will be an uphill battle as Blackstock is not entitled to spousal support.<\/p>\n
Clarkson has yet to publicly address the Starstruck battle.<\/p>\n
Earlier this month, she said that at one point in her marriage to Blackstock, she realized \u201cThis isn\u2019t happiness and we both deserve better.\u201d In November, she explained on her show that, \u201cPeople, like, could be bad for you in a certain time. And I think that everybody just goes, \u2018Oh, well that means they\u2019re bad.\u2019 Well, it doesn\u2019t necessarily mean that, it just means that you\u2019re on different paths. And I think that that\u2019s OK \u2026 Everybody\u2019s on a different learning curve.\u201d<\/p>\n
Bryan Freedman, attorney for Starstruck Management Group, told Page Six in response: \u201cThe labor petition conveniently ignores the fact that Kelly had her own licensed talent agency CAA at all times.
