Are you a theme park enthusiast and also a Swiftie? Do you often confuse the Taylor Swift album\u00a0evermore<\/em><\/a>\u00a0<\/em>and the fantasy themed amusement park, Evermore, located in Pleasant Grove, Utah? Then boy, oh boy, do we have a lawsuit right up your alley. On Wednesday, February 3,\u00a0Pitchfork\u00a0<\/em>reported<\/a>\u00a0<\/em>that mega pop star turned moody folk artist Taylor Swift is being sued by\u00a0Utah-based theme park Evermore Park<\/a>, for trademark infringement surrounding her latest smash hit album also named\u00a0evermore<\/em>. Random coincidence? Evermore the theme park thinks not. The suit, filed in a U.S. District Court in Utah on February 2, seeks millions in damages including all legal fees, claiming that\u00a0Swift\u2019s record-breaking album<\/a>\u00a0\u201chas led to confused guests and negatively affected the park\u2019s searchability on Google\u201d and allegedly \u201cinfringes on the park\u2019s merchandise designs and album covers for their original soundtracks.\u201d A cursory google search shows that the theme park is the number one his when you search \u201cEvermore Utah,\u201d but, sure, go off.<\/p>\n

Swift\u2019s lawyers are calling B.S., referring to the suit as \u201cbaseless\u201d in a letter filed in court. \u201cPut simply, the Swift Parties have not infringed your client\u2019s trademark,\u201d the letter states. \u201cIt is inconceivable that there is any likelihood of confusion between your client\u2019s theme park and related products and Ms. Swift\u2019s music and related products.\u201d The letter goes on to single out Evermore Park\u2019s merchandise, which includes \u201csmall dragon eggs, guild patches, and a small dragon mount,\u201d products that are not similar to those sold on Swift\u2019s website. Although it would be fun she did sell items such as these, but anyone worth their salt knows Swift\u2019s more into\u00a0snake eggs<\/a>. Swift and her team are denying the suit\u2019s request to \u201ccease and desist from [the] use of the EVERMORE trademark,\u201d so don\u2019t worry about the album getting pulled from streaming platforms any time soon. While we are sensitive to the plight of the small business owner, we do feel that instead of a lawsuit, a collaboration or licensing deal would benefit both parties. Imagine walking through a quaint old hamlet while \u201cdorothea\u201d plays over the loudspeaker? Pure bliss.<\/p>\n
